Does the notice period apply to fixed-term contracts?
Article 75 primarily applies to indefinite-term contracts. A fixed-term contract ends automatically when its term expires, unless it includes an auto-renewal clause — in which case the party not wishing to renew must give notice within the period agreed in the contract (commonly 30 or 60 days before the term ends).
What happens if I don't observe the notice period?
The party that fails to observe the notice period may be liable to compensate the other party for resulting damages, typically valued at the wages for the remaining unfulfilled notice period.
Can both parties agree to end the contract immediately without waiting out the notice period?
Yes, if both parties agree in writing to waive or shorten the remaining notice period, that agreement becomes effective. The issue only arises when one party ends the contract unilaterally without the other's consent.
Does giving notice affect my end-of-service gratuity entitlement?
No. The notice period is entirely separate from the end-of-service gratuity. Your gratuity entitlement is determined by the reason for termination (resignation or employer termination) and your length of service under Articles 84 and 85 — use the end-of-service calculator to work that out separately.
Must the notice specifically go through the Qiwa platform?
